The U.S. Department of Justice has indicted former FBI Director James Comey over an Instagram photo he posted last year. The image showed seashells arranged as “8647.” Some people interpreted “86” as slang for “get rid of” and “47” as a reference to Donald Trump, the 47th president, suggesting a possible threat.

Comey says he didn’t arrange the shells, didn’t know about any violent meaning, and removed the post after backlash.

Legal experts say the case is very weak. To convict, prosecutors must prove beyond a reasonable doubt that Comey intended to threaten the president, which is unlikely based on a beach photo. A past Supreme Court ruling protects even more explicit statements as free speech.

Critics argue this prosecution may be politically motivated, especially since similar phrases have been used publicly by others without consequences. Comey’s previous case was already dismissed, and many believe this one could also be thrown out before trial.
